Privacy Policy

Information AxiaGPT collects

In the last twelve months, AxiaGPT has collected, processed, or received the following categories of personal information under the CCPA and the CPRA:

a) personal identifiers: username, email address, phone number (if you turn on SMS notifications), encrypted password, IP address, account identifier, device identifiers, cookies, or other unique identifiers;

b) user-generated content: chat conversations, questions and answers, completed forms, and documents or files uploaded for review, translation, or training of artificial intelligence (AI);

c) transaction information: payment history through Stripe, amounts and dates, and type of plan purchased;

d) technical or network activity information: IP address, browser, operating system, time zone, language, referring URL, time on page, clicks, and pages visited;

e) general geolocation: approximate country or city derived from the IP address (AxiaGPT does not collect GPS coordinates or precise location);

f) profile or preferences: selected language, feature usage history, and types of cases consulted;

g) contact and support: messages sent to AxiaGPT’s contact addresses and support requests;

h) professional or commercial information, only if you provide it voluntarily.

AxiaGPT does not collect or process sensitive personal information under the CPRA, unless you voluntarily enter it in the chat or forms as part of your immigration matter. That information is not used for purposes other than those you request and is not shared with third parties.

Business and commercial purposes

AxiaGPT uses the information to: provide and operate the service; process payments; improve the product and train AI models in anonymized and aggregated form; personalize the experience; communicate with you and provide support; prevent fraud and maintain security; and comply with legal obligations.

AxiaGPT does not sell, share, or disclose your personal information for third-party targeted advertising, or in any way that could be considered a "sale" under the CCPA and the CPRA.

Use by adults only

Only individuals who are at least eighteen years old and have reached the age of majority under the law applicable where they reside may register with AxiaGPT, whether as account holders or as additional users of a shared account.

By registering, you represent and warrant that you meet this requirement.

AxiaGPT is intended exclusively for adults and does not knowingly collect personal information directly from minors, including children under thirteen protected by the Children’s Online Privacy Protection Act (COPPA).

Minors may not create accounts, receive access credentials, or use AxiaGPT’s services directly.

If AxiaGPT becomes aware that a minor has created an account or has directly provided personal information through the platform, it may suspend or cancel that account and delete the information provided by the minor, except information that must be temporarily retained to comply with a legal obligation, protect the security of the platform, prevent fraud, or document compliance with regulatory obligations.

Information about minors provided by an adult

Certain immigration matters may require an adult user to provide information about children, dependents, or other minors; for example, when they appear as beneficiaries, derivatives, dependents, or family members included in an immigration petition, application, or form.

In these cases, the minor’s information must be provided exclusively by an authorized adult and will remain associated with that adult’s account. The minor will not be considered an AxiaGPT user and will not have independent access to the platform.

When you provide personal information about a minor, you represent and warrant that:

a) you are the minor’s parent, guardian, or legal representative, you act with valid authorization from the person who holds that representation, or you are otherwise legally authorized to provide that information;

b) you have obtained, where applicable, the authorizations needed to provide that information and expressly consent, on the minor’s behalf and within the scope permitted by law, to AxiaGPT processing it in accordance with this Privacy Policy;

c) the information provided is accurate, relevant, and reasonably limited to what is necessary to prepare, complete, review, manage, or provide the requested immigration service;

d) you will not allow the minor to use your AxiaGPT account, password, access credentials, or other authentication mechanisms; and

e) you will be responsible for properly safeguarding any forms, documents, files, copies, downloads, or information about the minor that you obtain, print, store, or share from the platform.

When the service requires entering information about a minor, AxiaGPT asks the adult user for a specific confirmation and consent before allowing that information to be added or processed.

AxiaGPT keeps a record of that consent, including the date, time, user who gave it, and version of the notice or authorization accepted, to document compliance with its legal obligations.

Processing of information about minors

AxiaGPT will use personal information about minors only to the extent reasonably necessary to:

a) provide, operate, and support the service requested by the adult user;

b) prepare, organize, complete, or facilitate immigration forms, documents, and processes;

c) maintain the security and integrity of the platform;

d) prevent fraud, abuse, or unauthorized use;

e) respond to requests related to the minor’s data;

f) comply with legal, regulatory, or judicial obligations; and

g) perform the technical functions strictly necessary to provide the service.

AxiaGPT will not sell minors’ personal information.

AxiaGPT also will not use or share personal information about minors for targeted advertising, cross-context behavioral advertising, commercial profiling, or similar activities intended to determine or predict their consumer preferences.

Nor will AxiaGPT use minors’ personal information to train general-purpose artificial intelligence models or authorize its service providers to use it for that purpose.

When technology, infrastructure, storage, security, document processing, artificial intelligence, or other service providers need access to certain information to operate AxiaGPT, that access will be limited to the functions necessary to provide services to AxiaGPT and will be subject to the corresponding contractual and security obligations.

AxiaGPT will apply reasonable administrative, technical, and physical measures to protect minors’ personal information against unauthorized access, loss, use, disclosure, modification, or destruction.

AxiaGPT will retain that information only for the period reasonably necessary to provide the requested service, maintain required records, resolve disputes, prevent fraud, exercise or defend legal rights, or comply with legal or regulatory obligations.

When the information is no longer necessary, AxiaGPT may delete or anonymize it in accordance with its data retention policies and applicable law.

Rights regarding minors’ information

The parent, guardian, legal representative, or legally authorized person may request, as applicable and subject to applicable law:

a) access to the minor’s personal information held by AxiaGPT;

b) correction of inaccurate information;

c) deletion of that information;

d) information about the processing performed; or

e) any other right recognized by applicable law.

These requests can be made by writing to admin@axiagpt.com.

AxiaGPT may request the information reasonably necessary to verify the identity and authority of the requester before providing access to, modifying, or deleting a minor’s personal information.

Anyone who believes that a minor has provided personal information directly to AxiaGPT without the involvement or authorization of a parent, guardian, or legal representative may report it to the same address.

Your privacy rights

Depending on where you live and the law applicable to AxiaGPT, you may have certain rights regarding your personal information.

California residents. To the extent the CCPA, as amended by the CPRA, applies to AxiaGPT and the relevant personal information, California residents may have, among others, the following rights:

a) to know the categories and specific pieces of personal information that AxiaGPT collects, uses, discloses, sells, or shares, as applicable;

b) to request access to their personal information;

c) to request deletion of certain personal information;

d) to request correction of inaccurate personal information;

e) to opt out of the sale or sharing of personal information when those activities occur;

f) to limit certain uses or disclosures of sensitive personal information, where that right applies;

g) to receive information about the categories of third parties to whom information is disclosed; and

h) not to receive discriminatory treatment for exercising the rights recognized by applicable law.

AxiaGPT does not sell its users’ personal information and does not use minors’ personal information for targeted advertising or cross-context behavioral advertising.

Residents of other U.S. states. If you live in a state that recognizes additional rights under a comprehensive consumer privacy law – such as those of Virginia, Colorado, Utah, or Connecticut –, you may exercise the rights that apply under that law. Depending on the state and applicable law, these rights may include, among others:

a) access to your personal information;

b) correction of inaccurate information;

c) deletion of personal information;

d) obtaining a copy or portability of certain data;

e) opting out of the sale of data;

f) opting out of certain targeted advertising;

g) opting out of certain profiling activities;

h) revoking certain consents;

i) limiting the processing of certain sensitive data; and

j) filing an appeal when AxiaGPT denies a request and applicable law recognizes that right.

AxiaGPT will handle requests in accordance with the requirements, exceptions, procedures, and deadlines set by applicable law.

How to exercise your rights

You may submit a request related to your privacy rights by writing to admin@axiagpt.com with the subject "Privacy Rights Request." The request must include enough information for AxiaGPT to reasonably understand, evaluate, and address it.

AxiaGPT will respond within a maximum of 45 days, extendable by another 45 days (90 in total) with prior notice.

To protect your information, before responding to certain requests AxiaGPT may ask you to verify your identity using reasonable methods proportionate to the nature of the information involved.

When applicable law allows an authorized agent to submit a request, AxiaGPT may require reasonable evidence of the authorization granted and, where permitted, verify the identity of the data subject directly.

When the law of the relevant state recognizes a right to appeal, you may appeal the denial of a request by replying to the corresponding communication or by writing to admin@axiagpt.com with the subject "Privacy Request Appeal." AxiaGPT will respond within the period set by applicable law and, where required by law, will inform you of the mechanisms available to file a complaint with the competent authority.

AxiaGPT retains records of requests for a minimum of 24 months in accordance with the CCPA and the CPRA.

Data security

AxiaGPT applies technical and organizational measures: SSL/TLS (HTTPS) encryption, strong passwords, restricted access, periodic reviews, and service providers with appropriate security measures.

Data retention and deletion

Documents you upload to your case (for example, a passport, I-94, Social Security card, or other identity documents) are automatically deleted twenty-four months after they were uploaded.

You may delete a case at any time; when you do, AxiaGPT deletes all of that case’s information, including your answers, the people listed, uploaded documents, and generated forms. If you delete your account, AxiaGPT deletes all information associated with it.

AxiaGPT may retain records reasonably necessary to comply with legal obligations or to respond to a payment dispute, in accordance with the Refund Policy.

Changes to this policy

AxiaGPT may update this Privacy Policy to reflect changes in its practices, its technologies, or applicable law. The "Last updated" date indicates the current version.
